HCD Publishes Stats on Violations of Codes, Regulations. Residents Win!

The  following are the top ten violations by occupants of mobilehomes in  California mobilehome parks discovered during Park Maintenance Inspections conducted between January 1, 2018, and June 30, 2018, and their previous ranking during 2017. 

This is a serious matter. Tenants can be evicted from a mobilehome park for violations of code, without any warning at all from park owners---

"A tenancy shall be terminated by the management only for one or more of the following reasons: ¶(a) Failure of the homeowner or resident to comply with a local ordinance or state law or regulation relating to mobilehomes within a reasonable time after the homeowner receives a notice of noncompliance from the appropriate governmental agency."

Since code violaitons by residents are often dangerous, HCD or local code enforcement agencies (LEA's) warnings are all that fairness requires. Note that the Code does not allow for specfic termination for dangerous crimes on other victime residents, including violent, terrorist, or dangerous conduct, injury, assault, homocide or rape for example.

The legislatore refuses to address real mobilehome park victims, despite WMA's and CMPA's ongoing efforts, each time blocked by Senate Judiciary and GSMOL (for largely unintelligible reasons).

An uncategorized plumbing hazard within the park such as: inadequate slope on a drain line, undersized piping, unapproved fittings, etc.

If the park operator does not comply with HCD or LEA warnings, the permit to operatre may also be rescinded. This means the park is unable to operate. It also means the park operator is forbidden to collect any rent. The park then becomes instantly revenue-insolvent and may be required to cease doing business and close. However, some question whether the remedy is overly harsh and possibly unconstitutional as disproportional to the conditions to be remedied. Inability to collect rents due to tenant violations seems somewhat a debatable issue. Here are the parks currently subject to PTO revocation per HCD.

If the operator does not comply with codes, eventually, the PTO may be revoked. None of these parks are represented by Dowdall Law Offices, A.P.C., yet. Actually, I am not sure if any are represented by any attorney.
